The Federal Government of Nigeria has secured funding from the African Development Bank, Agence Française de Développement, and the Islamic Development Bank for the Investment in Digital and Creative Enterprises Programme. This programme aims to support entrepreneurship, boost innovation, create jobs, improve social development, and transform the economy by growing the digital technology and creative industries in Nigeria.

The programme has three key parts that aim to fill gaps and build on what is already happening in Nigeria’s tech and creative sectors. The first part focuses on developing skills and businesses for young people aged 18 to 35. The second part looks at providing funding to support early-stage startups. The third part aims to create a supportive environment through policy and advocacy by developing a framework for relevant policies that will enhance both sectors.

In line with this, the iDICE Programme Coordination Unit at the Bank of Industry, which is in charge of this programme, is looking to hire a Consultant. This consultant will help in adapting the Startup Act for use in various states.

The main goal of this consultancy is to adapt the Startup Act in states, as outlined in the iDICE programme’s Assessment Report. This includes advocacy and awareness campaigns to support the implementation and localization of the Startup Act at both Federal and State levels.

The consultancy will include several tasks:

a) Setting up a Policy Working Group for iDICE: This group will gather policy experts to help achieve the consultancy's goals and coordinate their efforts.

b) Mapping Policies: Create a Policy Map that shows key areas, best practices, gaps, and needs in the tech and creative sectors regarding policy action.

c) Engaging Stakeholders: Work with public and private sector policy makers across Nigeria’s tech and creative industries. This includes agencies like the National Information Technology Development Agency, the National Startup Act Secretariat, and various State Governments.

d) Creating a Policy Implementation Plan: Develop a plan to help access incentives at the federal level and adapt the Startup Act for states. This will include identifying policy actors, necessary actions, and possible legislation needed for these changes.

e) Implementation: Work with specific regulators and legislative bodies to carry out the policy changes identified.

f) Supporting State Domestication: Conduct diagnostics at the state level to find policy, legal, and institutional gaps. Identify and rank states based on their readiness and maturity of their ecosystems. Provide advice and support for creating state-specific legal and regulatory frameworks that comply with the Startup Act.

This will involve:

i. Reviewing all related iDICE Programme documents and relevant laws and regulations.

ii. Creating a work plan for project deliverables and stakeholder engagement.

iii. Working with identified public sector actors to effect needed policy changes.

To qualify for this consultancy, candidates must have:

a) At least 20 years of experience in law or a related field, particularly in drafting legislation in Nigeria.

b) Experience working with Development Finance Institutions in Nigeria.

c) Knowledge of Nigeria’s Technology and Creative Sector.

d) Experience in producing detailed analytical reports.

e) Proven ability to advocate for policy changes and negotiate with regulatory bodies and industry players.

f) Proficiency in multiple languages to ensure effective communication across Nigeria.

g) Expertise in aligning local policies with international standards, ensuring competitiveness.

h) Experience in conducting regulatory impact assessments to see how policy changes might affect the economy and society.

i) Proven ability to enhance institutional capacities to carry out and enforce new policies effectively.

Expressions of Interest should include:

a) Details of the firm or consortium, including strengths and relevant information (maximum 3 pages).

b) Experience in similar projects (maximum 7 pages).

c) Availability of Key Experts.

d) Any additional documents believed to be relevant.

EOI submissions should not exceed 25 pages, excluding the required documents.

The selection process will follow the African Development Bank’s Procurement Policy for operations funded by the Bank, which is available on the AFDB’s website. Just showing interest does not guarantee inclusion in the shortlist.

A Consultant will be selected based on the Quality and Cost Based Selection method outlined in the Procurement Policy.
