NESTOIL LIMITED UNDER RECEIVER MANAGEMENT: RESPONSE TO EDITORIAL IN THE GUARDIAN NEWSPAPER DATED NOVEMBER 14, 2025

The Receiver/Manager of NESTOIL LIMITED and NECONDE ENERGY LIMITED has responded to an online editorial in The Guardian published on November 14, 2025. The article, titled “Enforcement of expired ex parte orders against Nestoil, Neconde unlawful,” lacks an author.

The editorial quoted unnamed “legal experts” about the Ex-parte Orders from October 22, 2025. These orders were obtained from the Federal High Court in Suit No.: FHC/L/CS/2127/2025. The article claimed these orders have expired based on Order 26 Rule 10 (1) and (3) of the Federal High Court (Civil Procedure) Rules, 2019.

The editorial also claimed that the Receiver/Manager took over the companies’ head office in Victoria Island and disrupted crude oil production and export in OML 42. This claim is false and unfounded. It could lead to legal issues for those who published it.

The writers of the editorial should seek legal advice from their “legal experts” regarding these claims.

The Receiver/Manager was appointed under the Deeds of Appointment dated August 19, 2025. This appointment was announced in the Punch and Guardian Newspapers on October 29, 2025, on pages 45-46 and 32-33.

The editorial misinterprets the Federal High Court (Civil Procedure) Rules. The orders are still valid. After a petition from some Defendants against the presiding Judge, the proceedings were paused. This was done to follow the Chief Judge of the Federal High Court's directive. As a result, the Court’s orders from October 22, 2025, remain effective.

The public is advised not to rely on legal advice from an anonymous online editorial, even if it comes from a newspaper.

The public should also remember that any dealings with anyone claiming to act for NESTOIL LIMITED or NECONDE ENERGY LIMITED, especially concerning projects, contracts, and commitments in oil, gas, power, and infrastructure, without the knowledge and permission of the appointed Receiver/Manager will be considered ILLEGAL.
